New Jersey Residential and Commercial Terms & Conditions:
This Energy Sales Agreement (“Agreement”) with Core Energy Inc., (“Core Energy”), an independent supplier of natural gas shall consist of: (1) your telephonic, electronic or written agreement to initiate service and begin enrollment with Core Energy (“Enrollment Consent”) and (2) the terms and conditions listed below.
Satisfaction Guarantee: Core Energy is committed to total customer satisfaction, Core Energy will refer all complaints, written or verbal, to a person who will acknowledge them promptly and work out a mutually satisfactory resolution.
Primary Terms and Service: September 2010 to September 30th 2011.
Core Energy (“Company”) agrees to act as your exclusive natural gas supplier and you agree to purchase all of the natural gas necessary to satisfy your requirements for the utility account(s) identified in your Enrollment Consent during the term of this agreement. The start date of this agreement will begin with the acceptance of your enrollment by the Utility and verified by Core Energy. You have a 14 day right of rescission that begins with the date of your enrollment letter from New Jersey Natural Gas. Customer understands there may be delays in starting gas service under this agreement and will not hold Company responsible for any delays. You agree to accept the measurements of gas usage supplied by the utility for the purposes of accounting for the natural gas delivered by the utility. If the utility is unable to read your meter, the utility will estimate your usage and your charges will be calculated based on the estimates and be adjusted on a future bill.
Price: Fixed Price Term SEP -2010 – SEP 2011. The price of gas supplied to you under this agreement will be $Call for Pricing (Cents) per Therm of usage as measured by the Utility. There are no additional fees for switching your natural gas service.
Secondary Term: This agreement will automatically continue for additional one-year period(s) with the issuance of our Not to Exceed Variable Price offer presented to you between July 1st and September 1st of each year. Company will notify me at least 30 days prior to the end of my primary term or any secondary term(s) of Company’s intention to continue or terminate service under this agreement and of any applicable changes to the terms and conditions including any new charges or changes to the rate. You will also have the right to cancel this agreement at that time and if you do not cancel at least 20 days prior to the end of the primary term or any secondary term(s) then this agreement will automatically continue for an additional secondary term(s) and will include the proposed changes.
If You Move: If you move to an address outside of your current local Utility service territory, this agreement will automatically terminate with no cost to you. If you move to an address within the service territory, you agree that the Company may, at its option, automatically continue this agreement at your new address.
Cancellation: Customers may cancel service at any time by calling 877-329-3495. We value your business and sincerely want to hear your opinions and concerns if you are considering cancellation.
Amendments: Company reserves the right, with 10 days advance written notice, to amend this agreement due to any regulatory, tariff, procedural change or market factors that may affect the Company’s ability to serve you under this agreement.
Billing: For your convenience you will only receive one bill, which will be issued by NJNG and will contain Company’s gas price inclusive of sales tax. Customer agrees to pay NJNG for the entire gas bill under the NJNG payment terms and conditions. Company reserves the right to issue an invoice to Customer directly and if so the invoice will contain Company’s gas price plus sales tax and any other applicable charges. The Company may terminate this agreement with 15 days notice for customer non- payment.

Eligibility: Participation in the program is subject to the rules and regulations of the NJNG Customer Choice Program and customers are sometimes terminated from the program by error or by being in arrears. Should customer fall into arrears during the primary or secondary term of the Agreement Company may elect to reenroll such customers. Customer may contact NJNG to resolve the problem and be reinstated to the program. These Terms and Conditions are subject to Customer acceptance into the program by both the Company and NJNG. This agreement is not binding until such acceptance has been granted.
Assignment: This agreement is assignable by Company without Customer consent and only subject to any regulatory approvals.
Regulatory: The NJNG Customer Choice Program is subject to ongoing regulatory evaluation and Customer understands that if the program is terminated at any time this agreement will be cancelled without penalty to either party. In any provision of the Agreement is held by a court or regulatory agency of competent jurisdiction to invalid, void or unenforceable, the remaining provisions shall continue in full force without being invalidated in any way.
Force Majeure: Core Energy may not be responsible for supplying natural gas to Customer in the event of circumstances beyond its control such as events of Force Majeure as defined by NJNG or any transmitting or transportation entity, acts of terrorism or sabotage, or acts of God including but not limited to floods, fires, earthquakes, landslides and extreme weather conditions that impact an entire geographic region. In the case of such an event, Core Energy shall at its sole option, reject this contract in whole or re-determine its supply price and continue to provide service to Customer.
Liabilities: Neither the Customer nor the Company shall assume liability or responsibility for any special, indirect, consequential or punitive damages for items associated with the failure of NJNG to perform its duties, including but not limited to operations and maintenance of their system or interruptions of service, termination of service, or from damages arising from structural damage as a result of negligence.
Governing Law: This Agreement is made and shall be construed in accordance with the laws of the State of New Jersey.
Dispute Resolution: In the event of a dispute Customer should contact NJNG at the number listed on their bill. NJNG will continue to deliver your gas, read your meter and maintain their delivery facilities. If Core Energy or NJNG cannot properly address your concern Customer may also contact the Division of Consumer Affairs 800-242-5846 or kconsumeraffairs@lps.state.nj.us.
Emergency: IF CUSTOMER SMELLS GAS YOU SHOULD IMMEDIATELY CONTACT NJNG AT 1-800-4-NJNG.
